General Participation & Assumption of Risk

By registering for or participating in an experience, workshop, program, class, or other offering provided by Michelle Dyett-Welcome and/or Breathe Easy Coaching, you acknowledge that participation is voluntary. Some offerings may include movement, body awareness, focused gaze, reflection, mindfulness, creative expression, emotional exploration, or other experiential practices.

You understand that participation in experiential and movement-based activities may involve physical, emotional, or psychological responses and may carry inherent risks. You voluntarily choose to participate and accept responsibility for determining what is appropriate for you throughout the experience.

 

Health & Personal Responsibility

You are responsible for participating within your own abilities and limitations. You are encouraged to listen to your body and inner experience at all times and may modify an activity, lower or redirect your gaze, keep your eyes open, remain seated, rest, pause, or discontinue participation at any time.

You are responsible for creating and maintaining a reasonably safe environment in which to participate, including clearing sufficient space for movement when applicable.

If you have a medical, physical, psychological, or other condition that may affect your ability to participate safely, you are responsible for consulting an appropriately qualified healthcare professional when necessary before participating.

 

Educational & Experiential Nature of Services

Unless expressly identified otherwise, these offerings are provided for educational, personal-development, wellness, creative, coaching, spiritual, or experiential purposes.

Participation does not constitute medical care, medical advice, psychotherapy, psychiatric care, diagnosis, treatment, crisis intervention, or emergency services and is not intended to replace care from appropriately qualified healthcare or mental-health professionals.

Participation in an offering does not establish a therapist-patient, physician-patient, or other healthcare-provider relationship with Michelle Dyett-Welcome or Breathe Easy Coaching.

 

Online Participation

For online experiences, you are responsible for selecting a private and reasonably safe location from which to participate and for determining whether your surroundings are appropriate for the activities involved.

For movement-based experiences, clear your movement area of objects or conditions that could create a hazard. Wear appropriate clothing and footwear, if applicable, and adapt all movements to your individual abilities and environment.

You are also responsible for your own internet connection, computer or mobile device, audio equipment, and other technology required to participate.

 

Experience-Specific Terms

The following provisions apply in addition to the general terms above when you participate in the identified experience.

 

IAM Remarkable™ Workshop

IAM Remarkable™ is an interactive educational workshop involving reflection, discussion, and voluntary participation concerning accomplishments, self-promotion, and related beliefs and social perceptions.

You determine what personal information you wish to disclose. While participants may be encouraged to respect one another’s privacy, confidentiality among participants cannot be guaranteed.

The workshop is offered live. Unless expressly stated otherwise, no participant recording, photographing, screen recording, reproduction, or distribution of the workshop or its materials is permitted.

 

YOU Are Remarkable™ Movement Experience

This is an embodied movement experience that may incorporate music, movement, reflection, body awareness, and invitations to connect with your inner experience.

All movement is invitational. Participate within your own abilities. You may modify movements, remain seated, rest, pause, keep your eyes open, or discontinue participation at any time.

You assume responsibility for determining whether and how you participate and for maintaining a safe physical environment.

 

Octopus Setup Spot™ Experience

The Octopus Setup Spot™ Experience is an experiential practice that may incorporate focused gaze, body awareness, somatic noticing, reflection, and use of Octopus Setup Spot™ materials.

Experiential practices can sometimes bring unexpected sensations, thoughts, memories, emotions, or other internal responses into awareness. You remain in control of your participation and may change your gaze, pause, decline an invitation, ground yourself, or stop participating at any time.

This introductory experience is educational and experiential and is not psychotherapy, medical treatment, diagnosis, or crisis care.

 

Chakradance™

Chakradance™ is an experiential movement practice incorporating music, movement, creativity, reflection, and related practices.

Participation is voluntary and should remain within your individual abilities and comfort. You may keep your eyes open, lower or redirect your gaze, modify your movement, remain seated, pause, or stop at any time.

Clear your movement area before participating and take responsibility for your physical surroundings and personal safety. Chakradance™ is an experiential movement practice and is not a substitute for medical or mental-health care.

 

RAW Release™ Experience

RAW Release™ is an embodied movement experience incorporating music, rhythm, movement, and expressive practices.

Movement and emotional expression may create physical sensations or emotional responses. Participate only within your own abilities and comfort. You may reduce the intensity of movement, remain seated, rest, pause, or discontinue participation at any time.

You are responsible for maintaining a safe physical environment and determining what level of participation is appropriate for you.

 

Registration & Payment

Registration is not complete until any required registration process and payment have been completed.

Prices, dates, times, formats, availability, and other offering details are provided at the time of registration and may vary among offerings.

You are responsible for providing accurate contact information so that necessary information concerning your registration can be delivered to you.

Completion of registration and, where applicable, payment constitutes acknowledgment of these Terms & Conditions. Where an affirmative acceptance box is presented during registration or checkout, selecting that box indicates agreement to these Terms & Conditions.

 

Cancellations, Refunds & Transfers

Unless a different policy is expressly stated for a particular offering, purchases and registrations are for the specific experience and date selected.

Any applicable cancellation, refund, credit, or transfer policy presented on the registration or purchase page at the time of purchase forms part of these Terms & Conditions.

If an offering is canceled by the organizer, registered participants will be informed of the available options, which may include rescheduling, credit, or refund as appropriate.

 

Intellectual Property & Recording

Program names, original materials, exercises, written content, presentations, card decks, recordings, graphics, and other proprietary materials provided as part of an offering remain the intellectual property of their respective owners.

Registration or participation does not grant permission to reproduce, record, publish, distribute, teach, sell, modify, or create derivative materials from proprietary content except where express written permission has been provided.

Participants may not audio-record, video-record, photograph, screen-record, livestream, or otherwise capture an experience or other participants without express permission.

 

Recording of Offerings

Certain offerings may be recorded when identified as such in advance. Recordings may be retained and may be made available through password-protected or restricted-access learning platforms to registered participants, purchasers, or participants in future programs.

Participants will receive advance notice when an offering is being recorded. Participants who do not wish to be visually or verbally captured may keep their camera off and refrain from speaking, using the chat, or otherwise sharing identifying information during recorded portions.

By choosing to participate on camera, speak, use the chat, or otherwise contribute after receiving notice that recording is taking place, you acknowledge and consent to your image, voice, name, chat contributions, and other voluntarily shared participation being captured as part of the recording.

Recordings may be edited and incorporated into educational, program, promotional, or marketing materials. Reasonable efforts will be made to protect participant privacy and to avoid using personal disclosures or sensitive sharing for promotional or marketing purposes. Participants may be cropped, blurred, edited, or otherwise de-identified when appropriate.

Participants who do not wish their identifiable image or participation to be used in promotional or marketing materials may contact Michelle Dyett-Welcome using the contact information provided on this website.

Recordings, facilitator-created content, and edited materials remain the intellectual property of Michelle Dyett-Welcome and/or the applicable rights holder. Participation in an offering or access to a recording does not transfer any ownership or intellectual-property rights to participants.

 

Replay Access

When replay access is included with an offering, the applicable access period will be identified in the offering information. For experiences providing 7-day replay access, access will remain available for seven days following release of the replay to registered participants.

Replay access is provided solely for the registered participant’s personal use. Participants may not record, download unless expressly permitted, copy, reproduce, share, distribute, publish, sell, publicly display, or provide recording access or credentials to another person.

Expiration of participant replay access does not require deletion of the underlying recording. Recordings may be retained, edited, archived, incorporated into protected educational or program materials, or otherwise used in accordance with these Terms & Conditions.

 

Respectful Participation

Participants are expected to interact respectfully with the facilitator and other participants.

Behavior that is threatening, harassing, discriminatory, deliberately disruptive, unsafe, or substantially interferes with the experience of others may result in removal from an offering.

 

Limitation of Liability

To the fullest extent permitted by applicable law, Michelle Dyett-Welcome and Breathe Easy Coaching will not be liable for indirect, incidental, special, consequential, or similar damages arising from participation in or inability to participate in an offering.

Nothing in these Terms & Conditions is intended to exclude or limit a right or liability that cannot lawfully be excluded or limited.

 

Changes to Offerings

Reasonable changes may occasionally be necessary due to circumstances including facilitator availability, technology issues, safety considerations, or other unforeseen circumstances.

When a material change affects registered participants, reasonable efforts will be made to communicate that change using the contact information provided during registration.

 

Changes to These Terms

These Terms & Conditions may be updated periodically. The effective date shown at the top of this page identifies the current version.

The terms applicable to a transaction or registration are those presented or incorporated into the registration process at the applicable time.

 

Privacy

Personal information is handled in accordance with the Privacy Policy available on this website.
